Terms of Service

1. Accepting these terms

By creating an account or using Poultrist you accept these terms. If you do not accept them, do not use the service.

If you are accepting on behalf of a business, you confirm you are allowed to bind that business.

2. Who can use Poultrist

You must be at least 18 years old. Poultrist is built for business use and is not intended for children.

3. Accounts

3.1 Two kinds of account

Owner accounts are created by you. You sign in with an email address and password, or with Google. An owner account creates a Business and everything inside it.

Staff accounts are created by an account owner, not by the staff member. Staff sign in with a username and password chosen by the owner and can only see the farms and features their role allows.

3.2 The Business is our customer

An owner account controls its Business. That includes creating and disabling staff accounts, setting roles and permissions, and deciding what happens to the Business data. If you are a staff member, the owner of your Business controls your access and can see the records you create.

3.3 Keeping your account safe

Keep your password and any second factor to yourself, and tell us promptly if you think someone else has access. You are responsible for what happens under your account.

3.4 Signing in with Google

If you use Google Sign-In, Google confirms your identity to us and gives us your email address and name. We never receive your Google password. You can stop using Google Sign-In by contacting us, but an account created this way has no password of its own until we set one up for you.

3.5 Two-factor authentication

You can protect your account with a code sent by email, or with an authenticator app plus one-time backup codes. Backup codes are shown once. If you lose both your authenticator and your backup codes, contact us at [email protected]. We may not be able to restore access.

Turning two-factor authentication on or off signs you out of all devices.

3.6 Confirming your email

New owner accounts must confirm their email address before signing in. Until then, the account exists but cannot be used.

4. Acceptable use

Do not:

• break the law, or use Poultrist to help someone else do so
• enter information about other people that you have no right to enter
• try to access another Business's data, or another user's account
• probe, scan, overload or interfere with the service
• copy, resell or white-label Poultrist without our written permission
• upload anything harmful, or anything that infringes someone else's rights

We may suspend an account that breaks these rules.

5. Your data

5.1 You own it

Flock records, production figures, sales, expenses, customer and supplier details, staff records and everything else you put into Poultrist stay yours. We do not sell it, and we do not use it to train anything.

5.2 What you let us do with it

You give us permission to store, copy, transmit and display your data for one purpose only: running Poultrist for you. This includes keeping backups and syncing between your devices. The permission ends when the data is deleted.

5.3 Information about other people

Poultrist lets you record details about your customers, suppliers and staff. That is personal information about real people, and you are responsible for it. You confirm that you are allowed to hold it, that you have told those people how it will be used, and that you will keep it accurate.

If you are in the UK or the European Economic Area, you are the data controller for that information and we are your processor. Our Data Processing Agreement sets out what that means and forms part of these terms.

5.4 Accuracy

Poultrist shows you what you put in. Feed conversion, mortality, profit and every other figure it calculates is only as good as the underlying records. Do not rely on it alone for veterinary, financial, tax or legal decisions.

5.5 Working offline

Some parts of Poultrist work without a connection. Records you create offline are stored on your device and sent to our servers when you are back online.

Two things follow from that. Data held on your device is protected by your device's own security, not ours, so use a screen lock. And if you uninstall the app or wipe the device before a sync completes, work that never reached our servers is gone.

5.6 Reports and exports

You can generate reports as PDF or spreadsheet files, and you can request a full export of everything your Business holds. A download link for a full export works for 24 hours, after which you need to request a fresh one. Anyone holding that link during those 24 hours can use it, so do not forward it.

Once you save or share a file, it is outside our control. Reports you share are also written to a temporary folder on your device, which the operating system clears on its own schedule.

6. Paid plans

6.1 Free and paid

Poultrist has a free tier and paid plans. What each plan includes is shown in the app.

6.2 How you pay

Paid plans are bought through the Apple App Store or Google Play, on Android and iOS only. The store takes the payment. We never see your card details.

6.3 Renewal and cancelling

Subscriptions renew automatically until you cancel. Cancel through your App Store or Google Play account settings, at least 24 hours before the next renewal. Cancelling stops the next charge and leaves your access running until the end of the period you paid for.

We cannot cancel a store subscription for you, and deleting the Poultrist app does not cancel it.

6.4 Refunds

Refunds are handled by the store you bought from, under that store's policy, not by us.

6.5 If a purchase does not show up

It can take a short while for a purchase to appear in the app. Use "Restore purchases" first. If it still has not appeared, contact us at [email protected] with your store receipt.

6.6 Price and plan changes

We may change prices and what plans include. We will tell you before a change affects a subscription you already have, and you can cancel before it takes effect.

6.7 Store terms also apply

Apple and Google impose their own terms on purchases made through them. Where those terms conflict with ours for a store purchase, theirs win. Apple and Google are not responsible for Poultrist itself, and any claim about the app is for us to answer, not them.

7. Our intellectual property

Poultrist, its name, logo, design and software are ours. These terms give you permission to use the service, not ownership of any part of it. Do not copy, reverse engineer or create derivative versions of it.

If you send us feedback or suggestions, we may use them freely and without owing you anything.

8. Services we rely on

Poultrist depends on other companies to work:

Their handling of personal information is covered in our Privacy Policy. We are not responsible for outages or changes in services we do not run.

9. Notifications

Poultrist sends push notifications about your farms. You can turn them off in your device settings. Some messages about your account, security or billing are not optional while you have an account.

10. Availability

We aim to keep Poultrist running but do not promise uninterrupted service. We may change, pause or withdraw features. If we withdraw something significant, we will give you reasonable notice and, where a paid plan is affected, a fair way out.

11. No warranty

Poultrist is provided "as is" and "as available". To the fullest extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and uninterrupted or error-free operation.

Nothing here excludes liability that cannot be excluded under Kenyan law, or under the consumer law of your own country where that applies to you.

12. Limit of our liability

To the fullest extent the law allows:

• we are not liable for lost profits, lost livestock, lost data, or indirect or consequential loss

This does not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

13. Indemnity

If someone brings a claim against us because of information you entered, because you broke these terms, or because you had no right to hold personal information you put into Poultrist, you will cover our reasonable costs in dealing with it.

14. Ending your account

14.1 Deleting it yourself

An account owner can delete their account from My Account. You confirm with your password, or by typing DELETE if you sign in with Google.

Deletion is scheduled, not immediate. Your account is disabled straight away, every device is signed out, and the account and its Business data are deleted 30 days later. Sign in again within those 30 days and the account is restored exactly as it was.

Staff accounts cannot delete themselves. Ask your account owner to remove yours.

14.2 Deleting the app

Uninstalling the app does not delete your account or cancel a subscription. Use the deletion flow above, and cancel through the store.

14.3 Suspension by us

We may suspend or close an account that breaks these terms, that puts other users or the service at risk, or that we are required to close by law. Where it is reasonable to do so, we will tell you first.

14.4 What happens to your data

After the 30-day window your Business data is deleted from our live systems. Backups are kept for up to 30 days after that, so a copy may exist for a short while longer before it ages out.

We keep invoices and payment records for 5 years, because Kenyan tax law requires it. Export your data before you delete your account if you want to keep a copy.

15. Changes to these terms

We may update these terms. If a change is significant we will tell you in the app or by email before it takes effect. Continuing to use Poultrist after that means you accept the new version.

16. Contact and notices

Reach us at [email protected] for support, or for legal notices. We contact you at the email address on your account, so keep it current.

17. Law and disputes

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.

If you are a consumer in the UK or the European Economic Area, this does not remove the protection of the mandatory consumer laws of the country you live in, or your right to bring a claim there.

18. General

If a court finds any part of these terms unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms without our permission. We may transfer ours if our business is sold or reorganised, and we will tell you if that happens.

These terms, the Privacy Policy and the Data Processing Agreement are the whole agreement between us about Poultrist.
